In consideration of FunSpark Playground Inc., operating as FunSpark Playground (the “Facility”), allowing me to attend at the Location or participate in any and all activities, use of equipment, and services offered at the Facility (the “Activities”), I hereby agree as follows on behalf of myself, my spouse, any minor in my care, and each of our respective heirs, assigns, personal and legal representatives, executors and estates:
Authority to Sign: I am the parent or legal guardian of any minor in my care, or I have permission from the parent/guardian to sign on their behalf. I agree that this agreement is legally binding on myself, my spouse, any minor in my care, and our respective heirs, estates, and assigns.
Risks of Participation: I understand that attendance at the Location or participation in the Activities involves inherent risks including injury, equipment failure, actions of others, property loss or damage, and exposure to illness or allergens. I acknowledge these risks could lead to serious harm, paralysis, death, or damage to personal property to me or any minor in my care. I knowingly and voluntarily accept all known and unknown risks for myself or any minor in my care, including those caused by the Facility’s negligence.
Release of Liability: On behalf of myself and any minor in my care, I release the Facility, its directors, officers, shareholders, employees, contractors, and all other persons or entities acting on their behalf (the “Released Parties”), and all other participants at the Facility, from any claims for loss, damage, or injury sustained by me or any minor in my care in connection with our attendance at the Location or participation in the Activities. I also agree not to make a claim against any third party who might then sue the Released Parties.
Your Responsibility for Costs: I agree to indemnify and hold harmless the Released Parties from any claims, demands, liability, and associated legal fees for injury or damage to any person or property caused by the actions of myself or any minor in my care. I accept full financial responsibility for property damage, including repair or replacement costs. I agree to pay any legal fees the Released Parties incur to enforce this agreement.
Medical Treatment: I authorize the Facility staff to provide first aid and seek emergency medical care for myself or any minor in my care. I will pay all medical costs for this care. I hereby release and indemnify the Released Parties from all liability and claims arising from such medical treatment, including any claims of negligent treatment.
Physical Condition: I confirm that I and any minor in my care are in good physical condition, are physically able to participate in the Activities, and have no known health conditions that would make such participation unsafe.
Grip Socks Requirement: I acknowledge that approved grip socks are mandatory for safety and hereby assume all risks and liability for any injury resulting from a failure by myself or any minor in my care to wear them as required.
Continuous Agreement: I agree this is a continuous, multi-use Agreement that applies to all visits by myself or any minor in my care. It stays in effect until I give written notice to the Facility’s management to cancel it.
Media & Surveillance Consent: I consent for myself and on behalf of any minor in my care to video surveillance for safety. I also allow the Facility to use photos or recordings of me and any minor in my care for promotional purposes, without compensation.
Rules & Supervision: I confirm that I have read and understood the Facility’s rules (the “Rules”). I agree that the Rules are part of this Agreement, and I will follow them. I will make sure any minor in my care also follows the Rules. I understand that I am solely responsible for their safety and supervision at all times. I will immediately remove the minor from participation and notify staff if I observe any unsafe condition or hazard, or if I believe they are injured, unwell, or otherwise unfit to continue playing.
I am at least 18 years old and legally authorized to sign this agreement.
I have read and fully understood all terms of this agreement.
I accept the risks and obligations described above.
